1. Purpose and Scope

This document establishes the conditions governing participation in retreats, activities, and services organized by (ORGANIZATION NAME) (hereinafter, the “ORGANIZATION”).

By registering for or participating in any activity, the participant declares that they have read, understood, and accepted these Terms, including the informed consent and limitation of liability provisions.

2. Nature of the Services (Non-Medical Services)

The activities offered by the ORGANIZATION are educational, experiential, spiritual, and wellness-oriented in nature.

  • The ORGANIZATION does not provide medical or psychiatric services.

  • Activities do not constitute medical diagnosis, treatment, or therapy.

  • Participation does not replace professional healthcare or psychological treatment.

Any information or guidance provided is for informational purposes only. Participants must consult a qualified healthcare professional regarding their health before participating.

3. Voluntary Participation and Informed Consent

Participation in the activities is entirely voluntary.

The participant expressly acknowledges and accepts that:

  • Activities may involve intense physical, emotional, or psychological experiences.

  • Individual reactions cannot be predicted.

  • Benefits or results are not guaranteed.

  • Participation may involve inherent risks.

The participant freely assumes all risks associated with participation.

4. Health Declaration and Fitness to Participate

By accepting this document, the participant declares that:

  • The health information provided to the ORGANIZATION is accurate and complete.

  • They are physically and psychologically fit to participate.

  • They do not suffer from conditions incompatible with participation unless expressly disclosed and authorized.

  • They will follow all instructions and safety measures.

The ORGANIZATION reserves the right to deny or limit participation where necessary to protect the participant or others.

5. Personal Responsibility

Participants are solely responsible for:

  • Their physical and psychological condition.

  • Their decisions, actions, and behavior during activities.

  • Informing the ORGANIZATION of relevant health conditions or changes.

The participant accepts full responsibility for any consequences resulting from their participation.

6. Limitation of Liability (Civil Liability Waiver)

To the maximum extent permitted by applicable law:

  • The ORGANIZATION shall not be liable for injuries, losses, damages, or adverse effects resulting from voluntary participation, except in cases of wilful misconduct or legally non-waivable liability.

  • Participants release the ORGANIZATION, its directors, facilitators, employees, and collaborators from claims arising from participation.

  • The ORGANIZATION is not responsible for indirect or consequential damages.

Nothing in this clause excludes liability where exclusion is not permitted under Spanish law.

7. Assumption of Risk

The participant expressly acknowledges and accepts:

  • Possible physical discomfort or injury.

  • Emotional or psychological effects.

  • Unpredictable personal responses to activities.

  • Environmental or group-related risks.

Participation occurs at the participant’s own risk.

8. Compliance with Laws

Participants agree to comply with all applicable laws and regulations.

The ORGANIZATION does not promote or authorize illegal conduct. Participants are responsible for their personal legal compliance.

9. Rules of Conduct

Participants must:

  • Respect staff and other participants.

  • Follow safety instructions.

  • Refrain from disruptive or dangerous behavior.

The ORGANIZATION may exclude participants whose conduct endangers themselves or others, without entitlement to refund where permitted by law.

10. Early Termination of Participation

If a participant withdraws voluntarily or is excluded for safety or conduct reasons, no refund shall be granted unless required by law.

11. Travel and Personal Property

Participants are responsible for travel arrangements and personal belongings.

The ORGANIZATION shall not be liable for loss or damage to personal items unless caused by proven negligence.

12. Data Protection

Personal data will be processed in accordance with:

  • Regulation (EU) 2016/679 (GDPR)

  • Organic Law 3/2018 on Data Protection and Digital Rights

Data is processed solely for service provision, safety, and legal compliance. Participants may exercise their data protection rights as established by law.

13. Image Rights

Participants authorize the use of photographs or audiovisual recordings taken during activities for informational or promotional purposes unless they expressly object in writing.

14. Force Majeure

The ORGANIZATION shall not be liable for failure to perform obligations due to events beyond its control, including natural disasters, public health emergencies, or governmental restrictions.

15. Governing Law and Jurisdiction

These Terms are governed by Spanish law.

Any dispute shall be submitted to the competent courts of Spain unless mandatory consumer protection rules provide otherwise.

16. Severability

If any provision of this document is declared invalid, the remaining provisions shall remain in force.

17. Declaration of Acceptance

By registering or participating, the participant declares that:

  • They have read and understood this document.

  • They freely accept the terms.

  • They give informed consent to participate.

  • They assume the risks described.
